On May 9, 2019, the Court of Appeals for the Federal Circuit issued a judgment in Engineered Corrosion Solutions v. South-Tek Systems, LLC, Potter Electric Co LLC, Appeal No. 2018-1685 in favor of South-Tek and Potter Electric, both represented by Coats & Bennett, PLLC.
In this case, Engineered Corrosion Solutions (represented by Finnegan, Henderson, Farabow, Garrett & Dunner, LLP), appealed the decision of the Patent Trial and Appeal Board (PTAB), which found all claims of U.S. Patent No. 9,186,533 to be invalid after South-Tek’s successful petition for Inter Partes Review (IPR) led by C&B Attorney Ed Green.
The Appeals Court not only affirmed the decision of the PTAB Per Curiam, but awarded costs to South-Tek after oral arguments presented by C&B co-founder David E. Bennett.
