In the recent Authors Guild v. HathiTrust decision from the District Court for the Southern District of New York, the court ruled that it was permissible fair use for a coalition of universities to create a digitized library of copyrighted works in view of the transformative nature how the works were used in the digitized library, as enhanced search options and access for the visually impaired were provided.
