Mr. Biller represents clients in patent, trademark, and copyright infringement litigation throughout the United States and before government agencies to include the Trademark Trial and Appeal Board. Mr. Biller and Coats & Bennett are one of the leading authorities nationwide in the area of architectural works copyright infringement. Mr. Biller also has experience litigating unfair trade practices, franchise disputes, false advertising, trade secrets, defamation, cyberpiracy, and trademark dilution cases. He is admitted to the practice of law in the State of North Carolina, before the U.S. District Courts for the Eastern, Middle, and Western Districts of North Carolina, the U.S. Court of Claims, the District of Colorado, and before the Federal Courts of Appeal for the Federal and Fourth Circuits. Mr. Biller won a $3 million patent infringement
judgment against Sears, Roebuck & Co – on summary judgment –
representing a small textile manufacturer. Mr. Biller successfully
defended another client in a trade dress lawsuit by convincing the court
to cancel the plaintiff’s ten-year-old, incontestable federal
trademark registration. Again, Mr. Biller won the case at summary
judgment, saving the client considerable cost and anxiety. Mr. Biller’s transactional practice includes negotiating and drafting agreements for patent, trademark, and copyright transactions, to include licensing agreements. He also assists clients with drafting and enforcing franchise agreements. Mr. Biller helps client select, clear, and maximize protection of their brands. He assists designers, film producers, and artists in protecting themselves from infringement during the creative process and in protecting their final work product against infringers. Mr. Biller is a partner with Coats & Bennett where he leads the firm’s litigation practice. He received his J.D. magna cum laude from Campbell University in 1997 where he was the managing editor of the Campbell Law Review and a member of the school's John Marshall moot court team. He served as a US District Court judicial clerk for the Honorable William L. Osteen, Sr. in the Middle District of North Carolina. Mr. Biller earned his undergraduate degree from Purdue University where he was a Distinguished Military Graduate. He served four years as an officer in the US Army and, as a Jumpmaster and Ranger, led soldiers in the 82nd Airborne Division. He is a member of the American Bar Association litigation, intellectual property, and franchise practice groups, the International Trademark Association, the Federalist Society, the Christian Legal Society, and Colonial Baptist Church.
